Reporting Misconduct or Irregularities

Article 54-bis of Legislative Decree No. 165/2001 governs the protection of public-sector employees who report misconduct (whistleblowing). Employees and collaborators of companies supplying goods and services may also submit reports concerning facts that come to their attention in the course of their employment or professional relationship.

The procedure is intended to bring to light unlawful conduct affecting the public interest and not to protect individual interests.

Reports may concern unlawful conduct or irregularities that come to the reporting person’s attention in connection with their employment. Reports may be submitted through internal channels, external channels (ANAC) or, in specific cases, through public disclosure.

The confidentiality of the reporting person’s identity is guaranteed, and reporting persons are protected against retaliation, discrimination or punitive measures resulting from the report.

Any retaliatory measures are null and void and may give rise to disciplinary liability. Reports must be sufficiently detailed and based on factual information. Protection does not apply in the case of defamatory reports or reports made intentionally or with gross negligence.

Public administrations are required to adopt secure procedures and tools for handling reports. The regulatory framework was strengthened by Legislative Decree No. 24/2023, which extended both the scope of protection and its field of application.

The University provides an online platform for reporting misconduct or irregularities pursuant to Article 54-bis of Legislative Decree No. 165/2001.

Reports must contain sufficient information to allow the facts to be reconstructed, including the context, the persons involved, and the manner and circumstances in which the events occurred. Reports are submitted through a dedicated platform, which issues a unique identification code that can be used to track the case.

To qualify as a whistleblowing report, the report must identify the reporting person.
